Dalam sistem peradilan pidana Indonesia yang baru, hakim tidak lagi diposisikan sekadar sebagai "corong undang-undang" (la bouche de la loi). Berdasarkan Kitab Undang-Undang Hukum Pidana (KUHP) hasil penyesuaian melalui UU Nomor 1 Tahun 2026 dan hukum acara pidana baru (KUHAP 2025), hakim diwajibkan mempertimbangkan serangkaian pasal krusial yang mencerminkan keseimbangan antara kepastian hukum dan keadilan substantif. Secara substantif, landasan utama hakim dalam menjatuhkan pidana merujuk pada Pasal 51 dan Pasal 54 KUHP.
